Introduction:
In July 2020, a lower court convicted former Prime Minister (PM) Mohd Najib bin Abdul Razak guilty, mainly on the embezzlement for fraudulently obtaining around RM42 million from SRC International, an ex-1MDB subsidiary. The scandal has exposed corrupt officials and financial institutions worldwide, spurred the U.S. Department of Justice to open what became its most biggest kleptocracy investigation.
Najib, who faces several trials over the allegations, kept denying wrongdoing.
On July 28, 2020, the High Court convicted Najib on 7 counts. This includes 1 count of power abuse (sentenced to 12 years in prison and RM210 million fine), 3 counts of criminal breach of trust, and 3 of money laundering, each sentenced to 10 years in prison per counts and as all sentences would be executed concurrently, Najib faces 12 years in prison in total and a fine of RM210 million.
Finally, on August 23rd , 2022, Chief Justice Tengku Maimun binti Tuan Mat declared that the court gave the defense time to counterargue, but they declined. She insisted that High Court Judge Mohd Nazlan Mohd Ghazali correctly found Najib guilty on July 28, 2020. Consequently, the Federal Court affirmed Najib’s sentence.
As the first former PM in Malaysia to be jailed, is Najib’s conviction a symbol of the transparency and independence of our judicial system? What is the impact? How will his conviction affect Malaysia’s politics and judiciary? Or it is a lesson to government and opposition politicians to avoid further blunders that cost billions?
