【联合文告】去中央化从砂拉越开始  领先全国落实地方选举

赵明福民主基金会与隆雪华堂民权委员会促请砂拉越首长阿德南,除了施压中央政府将权力下放,赋予砂拉越州更大权力,去中央化绝对可从砂拉越自己做起。砂拉越政府可在砂拉越州选前修改州法令 — 1996年地方政府法令(Local Authorities Ordinance 1996),领先全国恢复地方议会选举制度。此举可告诉砂拉越人民,阿德南领导的政治联盟身体力行,而非与联邦政府在大选前唱双簧,通过媒体虚构改革先锋的形象。

两会原则上支持政治权力去中央化的措施,天然资源、教育、州官方语言与地方政府权限应归州政府,联邦税收也应更公平分配给各州。然而,过去十年曝露的砂拉越政府的诸多治理弊端,例如12座巨型水坝计划将迁离数以万计的原住民,广泛开垦的棕油园侵占原住民的传统习俗地,都与州政府滥权批准发展计划有关,资源下方无法克服砂拉越政府内部腐败的问题。

因此,与其在州议会高谈阔论联邦政府权力下放,阿德南不如先将州政府的权力下放给地方政府。当地方政府能够反映民意,否决不利民生的发展计划,地方政府的自主性将成为制衡州政府滥权的良好民主机制,解决当今砂拉越人民面对的诸多问题。

“联邦宪法第95条和第76条已阐明联邦政府不能为砂拉越和沙巴两州的土地与地方政府范畴立法,砂拉越州可以避开半岛州属所面临的改革困境,成为最先恢复地方议会选举的州属。”

两会呼吁阿德南展示政治魄力,说到做到落实民主化,其它州属必定响应去中央化的呼声,激发新一波民主化的浪潮。

【Joint Statement】Sarawak to take the lead in Decentralisation by Implementing Local Government Election

Teoh Beng Hock Trust for Democracy and Civil Rights Committee of Kuala Lumpur and Selangor Chinese Assembly Hall urge the Sarawak Chief Minister Adenan Satem to initiate the decentralisation process which is under the state’s jurisdiction instead of demanding the federal government to relinquish power to Sarawak state government.

The two organizations state that Articles 95 and 76 of Federal Constitution provide that the federal government cannot enact laws on lands and local governments of Sabah and Sarawak, thus the Sarawak government can amend the state’s Local Authorities Ordinance 1996 toimplement the local government election. This will show that the political alliance led by Adenan is not masquerading as pioneer of reform but walking the talk for institutional reform.

The two organizations support in principal the decentralization of political power and are of the view that state resources, education, official language and local government should fall under the jurisdiction of the state government while the federal taxes ought to be distributed fairly and justly to all state governments.

The two organizations note with regret that in the past 10 years under the previous leadership, Sarawak were subjected to innumerous problems  such as the  uncontrolled expansion of oil palm estate resulted in inequitable deprivation of native customary lands of indigenous people, the SCORE’s 12 mega dams project which had and still will mercilessly displace tens of thousands of  the indigenous people. The above instance are just a few to evident the arbitrary and draconian administration of the state government at the expense of the people’s right to land, right to live and their right to a safe and quality environment.

The two organizations strongly believe that  decentralisation of power and resource will not help to eradicate corrupt practices of the Sarawak government.

Therefore, instead of advocating decentralisation in the state assembly, the two organizations urge Adenan to lead the democratic process of implementing local government election, relinquish the state government’s power to a people elected autonomy for accountability and responsibility. Adenan’s bold and dynamic step of democratization will earn support from his people and carve a name for himself in Malaysia history. Hopefully this will drive Malaysia to another wave of democratization.
