{"id":42532,"date":"2025-12-11T11:09:18","date_gmt":"2025-12-11T03:09:18","guid":{"rendered":"https:\/\/klscah.org.my\/?p=42532"},"modified":"2025-12-11T11:28:59","modified_gmt":"2025-12-11T03:28:59","slug":"call-for-independent-investigation-into-human-rights-violations-and-public-health-impact-of-health-centre-raid","status":"publish","type":"post","link":"https:\/\/klscah.org.my\/en\/2025\/12\/42532.html","title":{"rendered":"Call for Independent Investigation Into Human Rights Violations and Public Health Impact  of Health Centre Raid"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">We are alarmed by the many violations of human rights and due process during the raid of Kuala Lumpur health centre Otot2 and the arrest of the 202 men in the premise, conducted by the Royal Malaysia Police (PDRM) with other agencies, including Kuala Lumpur City Hall (DBKL) and Federal Territory Islamic Department (JAWI) on 28 Nov 2025.<\/span><\/p>\n<p><b>Human rights violations<\/b><\/p>\n<p><span style=\"font-weight: 400;\">According to documentation by human rights groups, detainees reported serious mistreatment throughout the raid, arrest, and detention. These accounts indicate 11 major human rights violations:\u00a0<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Violation of right to due process and detainees\u2019s rights;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Biased and intimidating statement-taking questions and process;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Poor management of the detainees;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Poor condition of the detention area, sleep deprivation and access to toilets;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Lack of adequate food or water for detainees while in police custody;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Lack of access to medical attention and medicine, as well as forcible disclosure of HIV status;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unnecessary physical force and other forms of aggression;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Verbal and psychological abuse;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sexual harassment and degrading treatment of the detainees;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unnecessary inspection of phones; and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Corruption.\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">These violations highlight serious breaches of constitutionally protected and internationally recognised human rights, and the lack of basic fairness and professionalism expected of law-enforcement agencies.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The treatment of the detainees in police custody violated rules safeguarded under the <\/span><a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/body-principles-protection-all-persons-under-any-form-detention\"><span style=\"font-weight: 400;\">Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment <\/span><\/a><span style=\"font-weight: 400;\">and the Nelson Mandela Rules.<\/span><\/p>\n<p><b>Transparency and accountability of law enforcement<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The detainees\u2019 right to dignity was severely violated because of their actual and perceived sexual orientation. We urge PDRM to uphold the rule of law, comply with the Criminal Procedure Code, and conduct all investigations with professionalism and respect for human rights, free from prejudice, moral judgment, or bias based on sexual orientation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Law-enforcement powers are granted and limited by law; officers must therefore carry out investigations with professionalism and impartiality, while upholding the dignity of detainees, who are innocent until proven guilty according to the law. It is also imperative for the police to perform their duties in a manner that maintains public trust.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We call on the <\/span><b>Human Rights Commission of Malaysia (SUHAKAM) and the Ministry of Health (MOH) to launch an immediate, independent, and impartial assessment and investigation<\/b><span style=\"font-weight: 400;\"> into the conduct of the relevant agencies throughout the raid, arrest, processing, and the prolonged detention after the magistrate denied the remand extension on the evening of November 29, 2025.\u00a0<\/span><\/p>\n<p><b>Impact of the raid on public health progress<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The raid resulted in severe public health impact. Many have reported increased strain on their mental health, including suicidal ideation and severe psychological distress. This has severely impacted their ability to perform daily tasks, including eating, working, sleeping, and seeking treatment, among others.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When safer sex tools, such as condoms or Pre-Exposure Prophylaxis (PrEP), are used to insinuate criminal acts, this effectively jeopardises national public health progress.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/justiceforsisters.org\/resources\/brief-survey-findings-analysis-the-police-raid-of-the-health-event-in-kelantan-significantly-increased-concerns-about-personal-safety-among-lgbtiq-people-nationwide\/#1-impacts-of-the-kelantan-police-raid-on-the-health-event-on-lgbtiq-and-non-lgbtiq-people-in-malaysia-\"><span style=\"font-weight: 400;\">previous survey<\/span><\/a><span style=\"font-weight: 400;\"> conducted by Justice for Sisters (JFS) revealed that\u00a0 61% of survey respondents felt unsafe attending government or NGO-organised health programs following the raid of a health event in Kelantan. Meanwhile, <\/span><a href=\"https:\/\/www.unaids.org\/sites\/default\/files\/media_asset\/03-hiv-human-rights-factsheet-gay-men_en.pdf\"><span style=\"font-weight: 400;\">UNAIDS\u2019s research<\/span><\/a><span style=\"font-weight: 400;\"> indicates that HIV prevalence is 5 to 12 times higher in countries that criminalise and actively prosecute people based on actual or perceived sexual orientation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The assessment and investigation should also examine the public health and human rights impacts of the raid. Timeline of key events<\/strong><\/p>\n<p><strong>28 Nov, Around 8 PM:<\/strong>\u00a0Joint raid on Otot2; 202 individuals arrested and held overnight, including the owner, staff, and patrons. Detainees were denied timely access to legal counsel and communication with families. Their identities and images were leaked, leading to public humiliation and loss of jobs.<\/p>\n<p><strong>29 Nov, 8.00PM-9.30PM:\u00a0<\/strong>The police sought 7 days\u2019 remand.\u00a0 Magistrate rejects remand extension for all Malaysian detainees, thus they should have been released promptly. The foreigners were remanded for 2 days under the Immigration Act.<\/p>\n<p><strong>29\u201330 Nov:<\/strong>\u00a0Detainees continue to be held. The first Malaysian detainee was released around 7:40\u20138:00 AM on Nov 30 (10 hours after remand hearing), the last Malaysian detainee at 3:15 PM (19 hours after remand hearing).<\/p>\n<\/div>\n<div id=\"ub-styled-box-7465940b-0792-49f5-9dd6-3e94256e1bc8\" class=\"ub-styled-box ub-bordered-box wp-block-ub-styled-box\">\n<p id=\"ub-styled-box-bordered-content-\" class=\"has-text-align-center\"><strong>B. Documented Human Rights Violations<\/strong><\/p>\n<p>1.\u00a0<strong>Violation of right to due process and detainees\u2019 rights<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Detainees were not informed of charges, rights of legal representation, or remand status.<\/li>\n<li>Police instructed them to leave key legal sections blank (eg, charges, appointment of lawyers, health issues, next of kin). Threatened with charges for \u201cobstruction\u201d when refusing to sign incomplete forms.<\/li>\n<li>Telephone access was denied for up to 8 hours or more. Some family members filed a missing persons report.<\/li>\n<li>Foreign nationals were denied embassy access and translators.<\/li>\n<\/ul>\n<p><strong>2. Biased and intimidating statement taking questions and process<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Detainees were never told of the charges against them, but the interrogation included leading, intrusive questions about sexual practices and sexual orientation. The police also refused or were very hesitant to make corrections to the statements, and inserted prejudicial and inaccurate wording. Detainees faced intimidation for requesting corrections, including yelling and being charged for obstruction of police duty. The questions appeared to presume guilt of the detainees.<\/li>\n<\/ul>\n<p><strong>3. Poor management of the detainees<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Forced to sit, stand, and re-queue repeatedly for no clear purpose.<\/li>\n<li>Overcrowded transport: 30\u201340 people packed into trucks meant for 20\u201325.<\/li>\n<\/ul>\n<p><strong>4. Denial of Toilet Access, Sleep Deprivation &amp; Poor Detention Condition<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Detainees were denied toilet access, told to urinate in bottles that were thrown at them. Some were told to tie their genitals with rubber bands as a \u201csolution\u201d. One detainee was denied access to a toilet even when vomiting. (At IPK KL)<\/li>\n<li>Detainees were placed in an overcrowded, poorly ventilated room. Detainees were only allowed to use an overflowing toilet, with no toilet paper or functioning flushing water. (At Dang Wangi)<\/li>\n<li>Prohibited from sleeping; Ordered to sit upright or \u201cmassage\u201d person in front to stay awake.<\/li>\n<\/ul>\n<p><strong>5. Lack of adequate food or water for detainees while in police custody<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>The Detainees were only provided extremely limited food and water (e.g. sharing one piece of bread among 3\u20135 people), and many drank toilet tap water to avoid dehydration. The food was only provided after a person had fainted. Many complain of gastric pains, digestive issues, and health problems following the detention.<\/li>\n<\/ul>\n<p><strong>6. Lack of access to medical attention and medicine as well as forcible disclosure of HIV status<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>At least three medical emergencies happened; the police were unprepared and unequipped.<\/li>\n<li>One seizure and two cases of severe panic attacks; officers laughed instead of assisting.<\/li>\n<li>Detainees were forced to verbally disclose their HIV status repeatedly.<\/li>\n<li>Those with chronic conditions were denied access to regular medication.<\/li>\n<\/ul>\n<p><strong>7. Unnecessary physical force, aggression, and violence\u00a0<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>During the statement-taking process, officers banged tables, slapped the detainee\u2019s face with paper.<\/li>\n<li>Detainees reported witnessing physical violence against other detainees during the raid and at IPK KL<\/li>\n<\/ul>\n<p><strong>8. Verbal and psychological abuse &amp; shaming<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Detainees were called by pejorative terms (e.g.\u00a0<em>bangang, barua, beruk, bodoh, lancau,<\/em>\u00a0<em>pekak)<\/em>\u00a0and other insults. Biased and homophobic remarks directed at detainees and bailors.<\/li>\n<li>Detainees were forced to sit or sleep in a sitting position on hard floors. Foreign detainees were handcuffed and forced to sleep in restraints.<\/li>\n<li>Following the detentions, the psychological toll is severe and immediate. An alarmingly high number of individuals reported debilitating symptoms of severe psychological distress such as insomnia, heart palpitations, hyper-vigilance, and suicidal ideation. Furthermore, some have entirely lost their ability to work, socialize, or leave home.<\/li>\n<\/ul>\n<p><strong>9. Sexual harassment &amp; degrading treatment of the detainees<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Officers made explicit comments about genitals. Flashlights pointed at a detainee\u2019s crotch; mocked by officers.<\/li>\n<li>One officer held his bare feet close to a detainee\u2019s face in a threatening manner.<\/li>\n<\/ul>\n<p><strong>10. Unnecessary inspection of phones<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Phones examined without consent; detainees forced to unlock devices using facial recognition.<\/li>\n<\/ul>\n<p><strong>11. Corruption\u00a0\u00a0<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>Officers allegedly asked, \u201cWhat can you give me since I helped you?\u201d Several detainees were asked to pay RM300, told they could \u201ccollect it back in three days.\u201d<\/li>\n<\/ul>\n<p>*<em>Non-exhaustive list.
